This episode of the Common Interest Podcast features Nick Porter from Keay & Costello.
Many condominium associations have a restriction on leasing built into their governing documents. CAI Advocacy has a stated position on “Tenants in Community Associations”. In Illinois, if an association finds that a unit owner & resident are not compliant with their association’s covenants regarding leasing, they are required to give a 10 day notice before any eviction action can be taken.
In Nick’s story, the unit owner is a corporation with an employee as the unit’s resident, and as such they believe themselves compliant with the association’s covenants. Listen to find out how the association was able to navigate this complicated situation.
Nick Porter from Keay & Costello shares a story about a condominium association with a covenant disallowing unit rental and requiring owner occupancy. When they find the unit in question is owned by a corporation and occupied by an employee, things get more complicated.
